Terms & Conditions
Last updated: November 2, 2025
These Terms and Conditions ("Terms") govern your access to yaninamerica.com and your use of home improvement services offered by YaniN America ("Company," "we," or "us"). By using the website or engaging our services, you agree to these Terms.
1. Services
YaniN America provides residential repair, remodeling, and maintenance services as described on our website or in written proposals. Scope, materials, schedule, and pricing are defined in signed agreements or approved written estimates. Verbal descriptions on the site are informational and not binding until confirmed in writing.
2. Estimates and Change Orders
Estimates are based on visible conditions and information you provide. Hidden damage, code upgrades, or design changes may require change orders with updated pricing and timelines. You will approve material changes before additional work proceeds.
3. Scheduling and Access
You agree to provide safe access to work areas, utilities, and parking as reasonably required. Delays caused by unavailable access, incomplete selections, or third-party inspections may adjust completion dates without penalty to the Company.
4. Payment
Payment terms appear on your proposal. Deposits may be required to reserve crews or order custom materials. Invoices are due according to the agreed schedule. Late payments may pause work and incur reasonable collection costs where permitted by law.
5. Warranties
We warrant workmanship for the period stated in your project documents. Manufacturer warranties apply to products we install. Warranty claims must be reported promptly with description and photos. Warranty does not cover damage from misuse, modifications by others, or normal wear.
6. Client Responsibilities
You are responsible for moving personal items, securing pets, and notifying us of hazards such as asbestos or lead paint where known. You represent that you have authority to authorize work on the property.
7. Permits and Compliance
When agreements include permit services, we file applications and schedule inspections as applicable. You cooperate with inspector access. Work performed without required permits at your request may limit warranties or compliance.
8. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising from services or website use is limited to the amount you paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
9. Indemnification
You agree to indemnify and hold harmless the Company and its personnel from claims arising from inaccurate information you provide, unauthorized site conditions, or use of the website in violation of these Terms.
10. Website Use
You may not scrape, reverse engineer, or disrupt the website. Content, logos, and images are protected by intellectual property laws. Limited personal, non-commercial viewing is permitted.
11. Communications
By submitting forms, you consent to receive responses by email. Marketing messages require opt-in and include unsubscribe options. Service-related messages may be sent regarding active projects.
12. Dispute Resolution
Parties will attempt good-faith resolution before formal proceedings. Where allowed, claims may be brought in courts of competent jurisdiction in the location specified in your signed contract, or otherwise as required by applicable law.
13. Force Majeure
Neither party is liable for delays caused by events beyond reasonable control, including severe weather, supply shortages, labor disputes, or public health emergencies.
14. Severability
If any provision is unenforceable, remaining provisions continue in full force.
15. Changes
We may update these Terms by posting a revised version on this page. Material changes apply prospectively. Continued website use after updates constitutes acceptance.
16. Contact
Questions about these Terms: hello@yaninamerica.com.
17. Subcontractors and Suppliers
We may engage qualified subcontractors and material suppliers to perform portions of your project. We remain responsible for coordination and quality standards defined in your agreement unless otherwise stated in writing.
18. Photography and Portfolio
With your permission, we may photograph completed work for our portfolio and marketing. You may withhold or revoke permission before photos are published; already-published materials will be removed upon reasonable request.
19. Hazardous Materials
If we discover suspected hazardous materials during demolition, work may pause until testing and remediation occur. Additional costs and schedule impacts will be documented in change orders.
20. Cancellation
Cancellation terms, including deposits and restocking fees for ordered materials, are specified in your proposal. Custom or special-order items may not be returnable once fabrication begins.
21. Entire Agreement
These website Terms supplement—but do not replace—signed project contracts. If a conflict exists, the signed contract controls for that project.
22. Governing Language
These Terms are written in English. Translations provided for convenience do not override the English version if meaning differs.
